These terms apply to the HackDiet iPhone application. Use of the App Store distribution itself is also governed by Apple's Apple Media Services Terms and Conditions, which take precedence over anything below in case of conflict.

What HackDiet is

HackDiet is a general lifestyle and well-being application for personal weight awareness and self-tracking.

What HackDiet is not

HackDiet is not a medical device. It is not intended for the diagnosis, prevention, monitoring, prediction, prognosis, treatment or alleviation of any disease, injury, or disability. It does not provide medical advice, clinical decision support, or treatment recommendations. The trend line and projected goal date are illustrative statistical visualisations of past entries, not a clinical prognosis. If you are managing a medical condition or making decisions about your health, please consult a qualified clinician.

Pricing

HackDiet is sold once for €4.99 (or local-currency equivalent) on the Apple App Store. There are no in-app purchases and no subscriptions. Family Sharing is enabled, so a single purchase covers your Apple Family group at no extra cost.

Refunds

Refunds are processed by Apple, not by us, and follow Apple's published refund policy. Request a refund at reportaproblem.apple.com.

Limitation of liability

To the maximum extent permitted by applicable law: the App is provided "as-is", without warranties of any kind. The publisher's total liability for any claim arising out of or relating to the App is limited to the amount you paid for it (typically €4.99). We are not liable for any indirect, incidental, special, consequential, or punitive damages — for example, loss of data, loss of profits, or harm of any kind that may relate to use of the App. This clause does not limit liability that cannot be limited by Dutch consumer-protection law.

Updates and discontinuation

We may update HackDiet from time to time, including bug fixes and new features. Updates remain part of your existing purchase — there is no upgrade fee within the v1.x line. We may discontinue the App if continued operation becomes unsustainable; if that happens we'll publish notice on this site at least 30 days in advance and ensure the data-export feature continues to work for the wind-down window.

Apple App Store EULA

Per Apple's licensing requirements, the following acknowledgements apply: the licensor is the publisher (Lambda M BV); the App is licensed, not sold, to you; the license is restricted to use on Apple-branded products that you own or control; and Apple is a third-party beneficiary of these terms with the right to enforce them.

Governing law and jurisdiction

These terms are governed by the laws of the Netherlands. Any dispute arising out of or in connection with these terms is subject to the exclusive jurisdiction of the courts of the Netherlands, without prejudice to any consumer rights you may have under applicable law in your country of residence.
